Otherwise known as Guilty Until Proven Innocent, wherein the inability to prove within a shadow of a doubt that the allegations AREN'T true becomes self-condemnation.
To transfer the principle to the case of scientific theories: Fact Until Proven Fiction, with the inability to explicitly disprove the theory leading it to become self-validating.

ok maybe mine was not such a good theory afterall . after watching 'road to guantanamo' on thurs i get very upset with the guilty till proven innocent idea, so best not to support any form of it
